1. Introduction Welcome to Internet Roamer. By renting Starlink internet hardware from us, you agree to be bound by the terms and conditions outlined in this Terms and Conditions (T&Cs) agreement. Please read these terms carefully before proceeding with the rental.

2. Rental Agreement These T&Cs constitute a legally binding rental agreement between Internet Roamer ("Lessor" or "We") and the individual or entity ("Lessee" or "You") renting the Starlink internet hardware and Pelican protective case and the usage of Starlink internet service.

Disclaimer of Internet Service Liability Internet Roamer (referred to as "Lessor," "We," or "Our") provides the Starlink internet hardware for rental purposes, enabling access to internet services. However, we explicitly disclaim any liability or responsibility for the quality, availability, reliability, or functionality of the internet service provided by Starlink or any other internet service provider. Internet Service Limitations: We acknowledge that the Starlink internet hardware requires a clear view of the sky and relies on satellite communication technology. As such, its performance may be affected by environmental factors, including weather conditions and obstructions. The internet service may experience temporary disruptions, latency, or outages that are beyond our control. Lessee Responsibility: The Lessee (referred to as "You") assumes full responsibility for the use of the internet service provided by the Starlink internet hardware during the rental period. This includes any consequences resulting from the internet service's performance, reliability, or suitability for the Lessee's specific needs. No Warranty: We make no warranties or representations concerning the internet service's quality, speed, or suitability for any particular purpose. The Starlink internet hardware is provided on an "as-is" and "as-available" basis, without any express or implied warranties. Limited Support: While we may provide general setup instructions and basic troubleshooting tips for the Starlink internet hardware, we do not guarantee the ability to resolve internet service issues or technical problems that may arise during the rental period. Independent Internet Service Provider: The internet service is provided and managed by Starlink or any other third-party internet service provider. Any issues or disputes related to internet service should be directed to the respective service provider. Indemnification: To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Ponderosa West, LLC, its officers, employees, and agents, from any claims, liabilities, damages, losses, or expenses arising from or related to internet service issues or disruptions during the rental period. Acknowledgment of Internet Service Limitations: By proceeding with this rental and using the Starlink internet hardware, you acknowledge that you have read and understood this disclaimer of internet service liability and accept any risks associated with internet service performance.

5. Rental Period The rental period will commence on the date of equipment pickup and will continue until the equipment is returned to our specified drop-off location. The rental dates are as agreed upon during the reservation process.

6. Rental Fee and Payment a. Rental Fee: The rental fee for the Starlink internet hardware is $35 per day. b. Payment: The Lessee agrees to pay the full rental fee in advance before taking possession of the equipment. Acceptable payment methods include credit/debit card and online bank transfer.

7. Security Deposit a. An authorization of funds will be put on the credit card used to book the rental and used for any damages incurred to the unit. This authorization serves as security against any damage, loss, or late return of the equipment. If the any portion of the equipment is damaged, the credit card will be charged for those damages.

8. Equipment Use and Care a. The Lessee agrees to use the Starlink internet hardware in a careful and proper manner, strictly following the manufacturer's guidelines and instructions. b. The Lessee will be responsible for any damage resulting from misuse, improper handling, or neglect of the equipment during the rental period. c. The Lessee shall not make any alterations or modifications to the equipment without prior written consent from the Lessor.

9. Liability and Insurance

a. The Lessee assumes all risks associated with the use of the Starlink internet hardware during the rental period.

b. The Lessee is responsible for insuring the equipment against loss, theft, and damage during the rental period. Proof of insurance may be required before the equipment is released to the Lessee.

10. Damages, Loss, and Late Return a. The Lessee shall promptly notify the Lessor of any damages or loss of the equipment during the rental period. b. The Lessee will be liable for any repair or replacement costs resulting from damages or loss of the equipment beyond normal wear and tear, which may be deducted from the security deposit.

11. Delivery and Return a. The Lessee shall pick up the Starlink internet hardware from our specified pick-up location at the beginning of the rental period. b. The Lessee shall return the equipment to our specified drop-off location at the end of the rental period.

12. Cancellation and Termination a. If the Lessee decides to cancel the rental reservation, a refund will be provided according to the following schedule: Cancellation made seven (7) or more days before the rental start date: 100% refund of the rental fee. Cancellation made less than seven (7) days before the rental start date: 50% refund of the rental fee. b. The Lessor reserves the right to terminate the rental agreement and repossess the equipment in case of any breach of these T&Cs by the Lessee.

13. Governing Law and Jurisdiction This Agreement shall be governed by and construed in accordance with the laws of Montana. Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the courts of Montana.

14. Entire Agreement These T&Cs constitute the entire understanding and agreement between the parties concerning the rental of the Starlink internet hardware and supersedes all prior and contemporaneous agreements, whether oral or written. By renting the Starlink internet hardware from Internet Roamer, you acknowledge that you have read, understood, and agree to abide by these terms and conditions.
